OVERVIEW

Welcome to Cabinform. Cabinform is the store and brand operated by CHINA YEAR MANAGEMENT LIMITED ("Cabinform," "we," "us," or "our"). We operate this store and website, including all related information, content, features, tools, products, and services, to provide customers with a curated shopping experience (collectively, the "Services"). Cabinform is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them (collectively, the "Terms"), describe your rights and responsibilities when you access or use the Services.

Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy, available at https://www.cabinform.top/policies/privacy-policy. If you do not agree to these Terms or the Privacy Policy, you must not access or use the Services.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified under applicable law.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, territory, or country of residence. If you permit a minor dependent to use the Services on a device that you own, purchase, or manage, you are responsible for supervising that use to the extent permitted by law.

To use certain parts of the Services, including placing an order, you may be asked to provide information such as your name, email address, billing information, payment information, and shipping address. You represent and warrant that the information you provide is accurate, current, and complete and that you have the right to provide it.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account, except to the extent that applicable law provides otherwise. You must promptly notify us at support@cabinform.top if you suspect unauthorized access to or use of your account. You may not transfer, sell, assign, or license your account to another person.

We may refuse registration, suspend access, or close an account where reasonably necessary to protect the Services, comply with law, prevent fraud or abuse, or enforce these Terms.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to describe and display our products accurately. However, colors, textures, dimensions, and appearance may vary from what you see on your screen because of device type, display settings, lighting, manufacturing tolerances, or other factors outside our control.

Except for rights and guarantees that cannot be excluded under applicable law, we do not warrant that a product's appearance will exactly match an online image or that a product will meet subjective expectations not expressly stated in the product description.

Product descriptions, specifications, prices, and availability may change at any time without notice. We may discontinue a product or limit quantities offered to any person, household, geographic region, or jurisdiction on a case-by-case basis. Any quantity limits or availability restrictions are subject to applicable law.

Product information is provided for general informational purposes and is not a substitute for professional medical advice, diagnosis, or treatment. Unless expressly and lawfully stated in a product description, our products are not offered to diagnose, treat, cure, or prevent a disease or medical condition. If you have a medical condition or concern, consult an appropriately qualified professional before using a product.

SECTION 3 - ORDERS

When you submit an order, you make an offer to purchase the selected products under these Terms. An automated order acknowledgement confirms only that we received your order; it does not mean that we accepted it. An order is accepted only when we send an acceptance or shipment confirmation and successfully process the required payment.

We may accept or decline an order for legitimate reasons, including product unavailability, suspected fraud, payment authorization failure, pricing or description errors, delivery restrictions, or a breach of these Terms. If we decline or cancel an order after receiving payment, we will refund the amount paid for the cancelled item or order using the original payment method, subject to applicable law.

Please review your order carefully before submitting it. Once an order is accepted or enters processing, we may be unable to change or cancel it. We will nevertheless honor any cancellation right that applicable law requires. If we decline, change, or cancel an order, we will attempt to notify you using the email address, billing address, shipping address, or telephone number provided with the order.

Purchases are subject to our Refund Policy at https://www.cabinform.top/policies/refund-policy. We do not generally accept returns because you changed your mind or for another non-quality reason. If an item arrives damaged, is incorrect, or has a confirmed quality issue, contact support@cabinform.top and provide the information and reasonable evidence we request, such as clear photographs. After verification, we will arrange a replacement at no additional cost. If a replacement is unavailable or cannot reasonably be completed, we will issue a refund. This paragraph does not limit any non-waivable consumer right or remedy.

You represent that purchases are for your personal or household use and not for unauthorized commercial resale or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged for a product will be the price displayed when the order is submitted and confirmed in your order confirmation, subject to correction of obvious errors as permitted by law.

For orders shipped to customer addresses in the United States or Canada, standard shipping is free, and the price includes any customs duties, import taxes, and customs-clearance charges that apply to importing the order. Applicable sales, use, provincial, state, local, or similar transaction taxes may be calculated and charged at checkout where required. Unless expressly stated otherwise, prices do not include optional expedited shipping or other optional services selected by you.

Prices in our online store may differ from prices offered by third parties. Promotions may be governed by separate terms. If promotion terms conflict with these Terms, the promotion terms govern only for that promotion.

You agree to provide current, complete, and accurate purchase, payment, and account information and to promptly update information necessary to complete your transaction or contact you.

You represent and warrant that you are authorized to use the payment method submitted with an order, that the payment information is accurate and complete, and that charges properly incurred under your order may be submitted to the relevant payment provider. You agree to pay the confirmed order total, including any taxes or optional charges disclosed before checkout.

SECTION 5 - SHIPPING AND DELIVERY

We provide free standard shipping to customer addresses in the United States and Canada. Estimated delivery is 7 to 14 calendar days after order acceptance. This period is an estimate, not a guaranteed delivery date, unless we expressly agree otherwise in writing.

Cabinform is responsible for applicable customs duties, import taxes, and customs-clearance charges for orders shipped to customer addresses in the United States and Canada. You remain responsible for providing accurate and complete delivery information and for being available to receive the shipment where required.

Delivery may be affected by carrier delays, severe weather, customs processing, public holidays, address errors, service interruptions, or other events outside our reasonable control. If we become aware of a material delay, we will provide notice and any opportunity to consent to the delay, cancel, or receive a refund that applicable law requires.

Title to and risk of loss for a product pass to you when you or a person designated by you, other than the carrier, takes physical possession of the product, except where applicable law requires a different rule.

You must notify us promptly at support@cabinform.top if tracking shows delivery but the package was not received, or if the shipment arrives damaged or contains the wrong item. SECTION 6 - INTELLECTUAL PROPERTY

The Services, including their trademarks, brand elements, text, displays, images, graphics, product reviews, videos, audio, software, and the design, selection, and arrangement of those materials, are owned by or licensed to Cabinform, its affiliates, or its licensors and are protected by applicable copyright, trademark, patent, and other intellectual property laws.

Subject to these Terms, you may access and use the Services for your personal, non-commercial use. You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, sell, license, or transmit material from the Services without our prior written permission, except where these Terms or applicable law expressly allows it.

Nothing in these Terms grants you a license or other right under any patent, trademark, copyright, or other intellectual property belonging to Cabinform, Shopify, or a third party except for the limited personal-use permission expressly stated above. All rights not expressly granted are reserved.

Cabinform's names, logos, product and service names, designs, and slogans are trademarks of Cabinform or its affiliates or licensors and may not be used without prior written permission. Shopify's names, logos, product and service names, designs, and slogans are trademarks of Shopify. Other names, logos, product and service names, designs, and slogans displayed through the Services belong to their respective owners.

SECTION 7 - OPTIONAL TOOLS

We may provide access to tools, applications, or functionality offered by third parties. We do not necessarily monitor or control those third-party tools.

To the fullest extent permitted by law, access to optional third-party tools is provided "as is" and "as available," without warranties, representations, conditions, or endorsement by us. We are not responsible for loss or damage arising solely from your use of an optional third-party tool. This does not exclude liability that cannot lawfully be excluded.

Your use of an optional tool is at your discretion and may be subject to the third party's terms and privacy practices. You should review those terms before using the tool.

New features, tools, and resources that we make available through the Services are also part of the Services and are subject to these Terms unless separate terms expressly apply.

SECTION 8 - THIRD-PARTY LINKS

The Services may contain links to, embedded content from, or functionality operated by third parties. We do not control and are not responsible for the content, accuracy, availability, security, products, services, or privacy practices of third-party websites or services.

If you leave the Services or interact with a third-party service, you do so at your discretion. Review the third party's terms and policies before providing information or entering into a transaction. Questions or complaints about a third party's products or services should be directed to that third party.

Nothing in this section excludes liability that applicable law does not permit us to exclude.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Cabinform is powered by Shopify, which enables us to provide the Services to you. However, sales and purchases made through our store are made directly between you and CHINA YEAR MANAGEMENT LIMITED, trading as Cabinform.

By using the Services, you acknowledge that Shopify is not the seller of Cabinform products and is not responsible for the sales transaction between you and Cabinform, including injury, damage, or loss resulting from products purchased from Cabinform. To the fullest extent permitted by law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with Cabinform. This release does not apply where it would unlawfully exclude a non-waivable right or liability.

SECTION 10 - PRIVACY POLICY

Personal information that we collect through the Services is handled under our Privacy Policy at https://www.cabinform.top/policies/privacy-policy. Certain personal information may also be processed under Shopify's Consumer Privacy Policy at https://www.shopify.com/legal/privacy/consumers. By using the Services, you acknowledge that you have had an opportunity to review these policies.

Because Shopify hosts the Services, Shopify collects and processes information about your access to and use of the Services to provide and improve its services. Information submitted through the Services may be transmitted to and processed by Shopify and other service providers in countries other than your country of residence, subject to applicable data protection law and the safeguards described in the relevant privacy policies.

Our Privacy Policy explains the categories of information we collect, the purposes for which we use it, the parties with whom it may be shared, applicable international transfers, retention, security, and the privacy choices and rights available to you.

SECTION 11 - FEEDBACK

If you submit, upload, post, email, or otherwise provide ideas, suggestions, reviews, proposals, plans, photographs, or other feedback relating to the Services (collectively, "Feedback"), you grant Cabinform a non-exclusive, perpetual, worldwide, transferable, sublicensable, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display that Feedback in any medium for purposes including operating, evaluating, improving, and promoting the Services, subject to applicable law and our Privacy Policy.

You represent and warrant that you own or have the rights necessary to provide the Feedback; that you have disclosed any compensation or incentive connected with it; and that the Feedback does not infringe intellectual property, privacy, publicity, contractual, or other rights, contain unlawful, defamatory, abusive, obscene, or misleading material, or contain malicious code.

Unless applicable law requires otherwise, we are not obligated to keep Feedback confidential, pay compensation for it, publish it, or respond to it. We may monitor, edit, decline to publish, or remove Feedback that we reasonably believe is unlawful, misleading, offensive, infringing, or contrary to these Terms.

You must not use a false identity or email address or misrepresent the origin of Feedback. You remain responsible for the accuracy and lawfulness of Feedback you provide. Nothing in this section transfers ownership of your Feedback to us or limits any moral right that cannot lawfully be waived.

SECTION 12 - ERRORS, INACCURACIES, AND OMISSIONS

Information in the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, specifications, pricing, promotions, offers, shipping charges, delivery estimates, or availability.

Subject to applicable law, we may correct an error, update information, or cancel an affected order at any time, including after an order is submitted. If we cancel an order after payment because of an error, we will refund the amount paid for the cancelled item or order. Nothing in this section permits us to avoid obligations or remedies that applicable law imposes.

SECTION 13 - PROHIBITED USES

You may access and use the Services only for lawful purposes. You must not access or use the Services, directly or indirectly:

(a) for an unlawful, fraudulent, harmful, or malicious purpose;
(b) to violate an applicable international, federal, national, provincial, territorial, state, or local law or regulation;
(c) to infringe or violate our intellectual property rights or the rights of another person;
(d) to harass, abuse, threaten, defame, discriminate against, intimidate, or harm another person;
(e) to transmit false, deceptive, or misleading information;
(f) to send or facilitate unsolicited advertising, promotions, junk mail, chain letters, spam, or similar solicitations;
(g) to impersonate another person or entity or misrepresent your affiliation with one;
(h) to upload, transmit, or distribute a virus, malicious code, or other material intended to interfere with the Services;
(i) to collect, track, or disclose another person's personal information without lawful authority;
(j) to reproduce, duplicate, copy, extract, sell, resell, or exploit any portion of the Services except as expressly permitted by these Terms or applicable law;
(k) to interfere with, bypass, defeat, or circumvent security, access-control, rate-limit, robot-exclusion, or authorization measures; or
(l) except as expressly permitted under Section 14, to use a robot, spider, scraper, data-gathering or extraction tool, automated process, artificial intelligence tool, Agent, or manual process to access, monitor, copy, or extract the Services without our prior written permission.

We may suspend, restrict, or terminate access where we reasonably determine that these Terms have been violated or where action is necessary to protect the Services, customers, Cabinform, Shopify, or third parties. Where required by applicable law, we will provide appropriate notice or an opportunity to challenge the decision.

SECTION 14 - AGENTS

14.1 This section (the "Agent Terms") applies if you use, permit, enable, or cause an Agent to access, use, or interact with the Services. An "Agent" means software or a service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or entity and can operate on or through a person's device or account without direct supervision for each individual action.

14.2 An Agent may access, use, or interact with the Services only while it identifies itself and complies with Section 14.4, these Terms, applicable law, and any published technical instructions. An Agent must not access, use, or interact with the Services after we have requested that it stop or where access is blocked or restricted.

14.3 We may use reasonable technical and operational measures to limit whether and how an Agent accesses, uses, or interacts with the Services.

14.4 An Agent must:

(a) identify every HTTP or HTTPS request as originating from an Agent and disclose the Agent's name by including `Agent/[agent name]` in the request's user-agent string;
(b) not conceal or obscure that access or interaction originates from an Agent, including by mimicking human behavior or interaction patterns or completing, bypassing, or circumventing a CAPTCHA or another measure intended to distinguish computer use from human use;
(c) answer truthfully any question or prompt intended to determine whether an interaction originates from a human or computer; and
(d) not circumvent or avoid a measure intended to block, limit, modify, or control whether or how Agents access, use, or interact with the Services.

14.5 Compliance with this section does not guarantee access and does not grant a license to copy, train on, extract, or commercially exploit content from the Services. We may withdraw or change permission for Agent access at any time, subject to applicable law.

SECTION 15 - TERMINATION

You may stop using the Services at any time. We may suspend or terminate this agreement or your access to all or part of the Services where reasonably necessary to enforce these Terms, comply with law, protect the Services or another person, prevent fraud or abuse, or discontinue the Services. Where applicable law requires notice, reasons, or an opportunity to remedy or challenge a decision, we will provide them.

Termination does not affect rights or obligations that accrued before termination, including your obligation to pay amounts properly due. Provisions that by their nature should survive termination will survive, including Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy, and payment obligations.

SECTION 16 - DISCLAIMER OF WARRANTIES

Information provided through the Services is for general informational purposes. Although we make reasonable efforts to keep information accurate and current, we do not warrant that all information will always be complete, accurate, or useful. Reliance on general information is at your own risk, subject to applicable law.

TO THE FULLEST EXTENT PERMITTED BY LAW, AND EXCEPT FOR AN EXPRESS PROMISE IN THESE TERMS OR A RIGHT OR GUARANTEE THAT CANNOT LAWFULLY BE EXCLUDED, THE SERVICES AND PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT EXPRESS OR IMPLIED WARRANTIES OR CONDITIONS, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT ACCESS TO THE SERVICES WILL ALWAYS BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OR ALL OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

This section does not exclude, restrict, or modify any statutory consumer guarantee, warranty, condition, right, or remedy that cannot lawfully be excluded, restricted, or modified.

SECTION 17 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, CHINA YEAR MANAGEMENT LIMITED, TRADING AS CABINFORM, AND ITS AFFILIATES, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS, AND SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL LOSS, OR FOR LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, LOSS OF GOODWILL, OR REPLACEMENT COSTS, ARISING OUT OF OR RELATING TO THE SERVICES OR PRODUCTS, WHETHER THE CLAIM IS BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR ANOTHER LEGAL THEORY, EVEN IF ADVISED THAT SUCH LOSS MAY OCCUR.

TO THE FULLEST EXTENT PERMITTED BY LAW, CABINFORM'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PRODUCT, ORDER, OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO CABINFORM FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM OR (B) USD 100.

Nothing in these Terms limits or excludes liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where it cannot be limited, or any consumer right, statutory liability, or remedy that applicable law does not permit us to limit or exclude.

Because some jurisdictions do not allow certain exclusions or limitations, some or all of this section may not apply to you. In those jurisdictions, liability is limited only to the maximum extent permitted by law.

SECTION 18 - INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold harmless Cabinform, Shopify, and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable legal fees arising directly from: (a) your material breach of these Terms; (b) your unlawful violation of a third party's rights; or (c) your intentional misuse of the Services.

This obligation does not apply to the extent a claim results from the negligence, willful misconduct, or breach of these Terms by the party seeking indemnification, and it does not apply where applicable consumer law prohibits it.

We will give you reasonably prompt notice of an indemnifiable claim, but delayed notice relieves you of an obligation only to the extent the delay materially prejudices your defense. We may control the defense and settlement at our expense or, where legally permitted and reasonably appropriate, at your expense. We will not settle a claim in a way that imposes a non-monetary obligation or admission on you without your consent, which must not be unreasonably withheld. You agree to provide reasonable cooperation in the defense.

SECTION 19 - SEVERABILITY

If a provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law. Any unenforceable portion will be severed or limited as necessary, and the remaining provisions will remain in effect.

SECTION 20 - WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce a right or provision of these Terms does not waive that right or provision. A waiver is effective only if it is in writing and applies only to the specific circumstance for which it is given.

These Terms, together with the policies and operating rules posted by us in relation to the Services, constitute the entire agreement between you and us regarding your use of the Services and supersede prior or contemporaneous agreements, communications, and proposals on that subject, whether oral or written.

Nothing in this section excludes liability for fraudulent misrepresentation or limits a right that cannot lawfully be waived. Any rule construing ambiguity against the drafting party is excluded only to the extent applicable law permits.

SECTION 21 - ASSIGNMENT

You may not transfer, assign, or delegate these Terms or your rights or obligations under them without our prior written consent. An attempted transfer that violates this section is void to the extent permitted by law.

We may transfer, assign, or delegate these Terms or our rights and obligations in connection with a merger, acquisition, corporate reorganization, sale of assets, financing, or transfer of the Services, provided that the transfer does not reduce non-waivable consumer rights. We will provide notice where applicable law requires it.

SECTION 22 - GOVERNING LAW

These Terms and any separate agreement under which we provide the Services are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-laws principles.

The courts of the Hong Kong Special Administrative Region have non-exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.

If you are a consumer, this section does not deprive you of any mandatory protection, right, remedy, or jurisdiction available under the law of your state, province, territory, or country of residence that cannot be excluded by agreement. You may bring a claim in any court or forum where applicable law gives you a non-waivable right to do so.

SECTION 23 - HEADINGS

Headings are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.

SECTION 24 - CHANGES TO TERMS OF SERVICE

You can review the current version of these Terms on this page at any time.

We may update these Terms by posting a revised version to the website. Where required by applicable law, we will provide reasonable notice of a material change and state when it takes effect. Changes will not retroactively reduce rights that accrued before the effective date unless applicable law permits and the notice clearly states otherwise.

Your continued use of the Services after revised Terms take effect constitutes acceptance of the revised Terms to the extent permitted by law. If you do not agree to a revision, you must stop using the Services. Changes to these Terms do not alter an already accepted order unless you agree or applicable law permits the change.
